Terms and Conditions

Payment
1) SASTRAD accepts payment in any currency by
T.T. (Telegraphic Transfer) to our bank account in Japan.
Deposit
1) A deposit is necessary before SASTRAD will commence with purchasing or bidding at
auction on units on the Clients behalf.
2) The deposit is 80,000 Japanese Yen (JPY) for vehicles under 2,000,000 JPY, and
200,000 JPY for units over 2,000,000 JPY. The deposit amount will increase by 100,000
JPY thereon by 1,000,000 JPY increments.
3) After remitting the funds, SASTRAD may ask you to fax a copy of the T.T. transaction
form immediately. SASTRAD will then begin sourcing units once our bank has confirmed
the Clients remittance.
4) Should the Client make more than 1 bid at auction without success, and thereafter
request the deposit to be refunded, an auction bidding fee of 2000yen for each bid
will be deducted from the refundable deposit.
Balance of Winning Purchase
The winning bid's invoice will provide the Client with the banking details,
invoice amount, any credits to their account and payment due date. Once receiving
this invoice from SASTRAD, the Client must remit the amount stated on the invoice within
48 hours.
Service Fees
As of January 1st 2009 our fees are 90,000yen/car for export, or 70,000yen for cars staying in Japan. For a container of mini trucks, each truck fee is 70,000yen.
SASTRAD is an export company that represents and acts on behalf of our clients who want used cars and trucks from Japan.
SASTRAD acts in a non-bias manner regarding auction houses or dealers when searching for the best vehicle for our clients.
SASTRAD is able to find the right vehicle for our client's orders, regardless of what auction or dealer it comes from in Japan. If
the potential vehicle is not in stock, SASTRAD can still get the given vehicle. Because
SASTRAD acts on the client's behalf at auctions, SASTRAD will show you what is available regardless of price. Remember also that you'll also have to pay for shipping your vehicle. Our fees are compared with what our competition is charging and are somewhat lower. All our prices are in Japanese yen, and so is our fee. Please contact us about our fee structure and to discuss your needs.
Service Fees Include:
1. Bidding at auction on your behalf. Since the auctions charge us a fee to bid, and even on a winning bid, we pay for that.
2. Arrange for the inland transportation to take the vehicle from the auction to either a port of discharge or our yard for container packing.
3. De-registration of the vehicle in Japan.
4. Arranging for any necessary inspections before exporting. This is particularly important for many countries, as they will not allow a vehicle to enter if it has not been inspected. We do not pay for the actual inspection costs, but will let you know the costs.
5. Arrange for shipping and make sure the vehicle gets on a ship to your country. We do not pay for the actual shipping costs.
6. All the necessary documents (inspection, shipping, ownership) delivered to the owner/notifying party.
Service Fees DO NOT include:
1. Japanese tax, road tax or recycle tax that may be remaining on the car when bought at auction.
2. Shipping insurance is an option but must be requested by the client. Insurance is not automatically placed on vehicles.
3. Extra storage fees due to a delay in shipping. Normally the shipping company will grant 1-month free storage. In the case of some tight shipping schedules, there may be a longer wait. We'll let you know of this situation ahead of time or present an alternative.
4. Vehicle delivery (inland transportation) from an auction or dealer to our car yard or port of departure. We will do our best to let you know of the extra inland shipping charges before placing a bid.
5. All necessary inspections required for the destination country. We'll inform you of the charges, but they may change from time to time. A receipt from the testing authority can be provided.
6. Extra services such as translations of documents (such as an owner's manual) not otherwise required for exporting the vehicle.
Shipping
By Container:
SASTRAD will inform the client of the container loading and shipping schedule
once the vehicle has been bought. SASTRAD will do its best to place the vehicle in a
container as quickly as possible. Due to the nature of container loading, a container
should not have less than 3 vehicles in it to make shipping more economical. As
such, larger vehicles (around 15m3 and over) may have a longer waiting time as fewer
can fit into a container. We will do our best to get vehicles out in a timely manner.
Individual Vehicle Inland Delivery (within Japan):
SASTRAD will arrange, once the Client's vehicle has been won at auction,
for inland transportation (delivery) to either the port of discharge or SASTRAD's
yard for container loading. This inland transportation is the expense of the Client,
and the Client should verify with SASTRAD of the amount. SASTRAD does its best to inform
the Client beforehand, but is not responsible for payment of inland transportation
should the said cost not be agreeable to the Client.
The Client should be mindful that there are other charges to individual RO-RO shipping.
There is always a port fee that is no less than 15,000yen. There may be other expenses
charged by Japan Customs
General
1) SASTRAD will send to you the required documents (bill of sale, export certificate
and its English translation, bill of lading, etc.) by EMS (Express Mail Service)
within 5 business days after payment for shipping has been received from the Client.
Sundry
2) SASTRAD will not be held responsible for any changes in the name of the vessel, shipping
dates, payment claim(s), etc caused by the Shipping Company. Nor will SASTRAD be held
responsible for any delays caused by the Customs Department in the importing country
(i.e. final destination of arrival).
Insurance
1) In the case of shipping, insurance is optional and must be requested by
the client. This insurance is on the vehicle while it is shipped until it reaches
the Clients desired port. This insurance only covers the total loss of the vehicle.
In the case of requesting insurance it is the Clients duty to inform the staff at
SASTRAD prior to the unit being shipped that insurance is to be placed on the unit (a
insurance fee will be incurred by the Client).
2) Since container shipping has only "total loss" insurance available,
the Client may wish to take out their own insurance to cover for damage incurred
while the vehicle is in transit. This is up to the Client to investigate and purchase
and not SASTRAD's responsibility
Cancellation
An agreement can be cancelled after SASTRAD has made a successful bid.
However, the deposit is forfeit, with no exceptions.
Registration on Auction Website
Upon receiving the required deposit amount, a client may registration
with SASTRAD�fs auction website at www.japancarexportsonline.net. Our client�fs personal
information will be protected with their password. The client will be responsible
for maintaining the ID and password securely. Once logged into Members area, a client
will not be logged out until all the browsers are closed.
Purchasing of Stock
When purchasing vehicles or parts directly from our stock, 100% payment
is due within 5 business days after receiving the invoice from SASTRAD. After confirmation
from our bank that all funds have been remitted, shipping arrangements will be made.
Claims
All claims against SASTRAD in respect of the new parts or stock vehicles
must be made by the Client in writing within 5 working days of the Client being
in physical possession of the Goods. SASTRAD may, at its absolute and sole discretion,
consider any claims made outside that time frame.
No claims can be accepted for vehicles bought at auction. All auction
sales are �gas is, where is, with no warranty or guarantee expressed or implied".
AUCTION PURCHASES EXECUTED ACCORDING TO CUSTOMER REQUIREMENTS AND STOCK PURCHASES
LISTED ON OUR WEBSITE ARE CONSIDERED FINAL SALES.
SASTRAD and the Client acknowledge and agree that SASTRAD will not be liable
for and the Client will not make any claims in respect of: Stereos, tires, electric
windows, mirrors, electric seats, electric sunroof, batteries, aftermarket extras,
vehicle interior, cruise control, tools, scratched alloy wheels, goods that have
been modified or a rated Accident or Repair (A or R) Grade Vehicles or all other
damage or defeats that have been noted in the description or checklist.
JCE's liability arising from a breach of any of its obligations under
these Terms and Conditions (including negligence) by SASTRAD will be limited to and
will not exceed the purchase price and all other warranties, descriptions, representations
and conditions as to fitness, suitability for any purpose or specific conditions,
even though such conditions may be known to SASTRAD, merchantability or otherwise whether
expressed or implied and whether statutory or otherwise are expressly excluded and
SASTRAD is not to be liable in anyway whatsoever to the Client or any third party, whether
in tort or contract, for any indirect, special or consequential loss or damage.
SASTRAD reserves the right to repair the Goods or refund the invoice price.
Title
If the goods are not paid for within a two-week period, SASTRAD may:
(a) Take possession or control of any Goods which are its property and dispose of
or retain them for its own benefit. The Client irrevocably authorizes SASTRAD, without
prejudice to any premises, or any premises occupied by the Client, where SASTRAD reasonably
believes the Goods may be stored in order to inspect, search for or remove the Goods.
SASTRAD is not liable to the Client or any third party for any injury or damage to any
person or the premises in the exercise of its rights under this clause and the Client
indemnifies SASTRAD against any claim made by a third party in respect of any such injury
or damage.
(b) Withhold without notice deliveries of further goods ordered by the Client.
Other Terms
Without prejudice to any other remedies of SASTRAD at law or under
these conditions, the Client is to pay interest on any amount that is not paid on
the due date at the default rate interest of 18% per annum above the current base
of lending rate of SASTRAD principal bankers on a daily basis from the date when the
payment is due until the date when payment is actually made and the Client will
be liable to pay all expenses and legal costs of SASTRAD as between solicitor and client
in relation to obtaining remedy of such failure to pay. The charging of interest
does not imply the granting of an extension of credit.
I hereby acknowledge that SASTRAD does not support any importation procedure. The buyer
is responsible for any necessary procedures, compliance, and modifications to legally
register the vehicle on the road.
Acceptance
By submitting a deposit for the use of purchasing parts or vehicles, the client
acknowledges that they agree to the terms and conditions of business and are subject
to said terms and conditions.
